A just and unified law to guarantee the rights of women and society

 Tammuz organization for social development held an educational seminar dedicated for the proposal of amending personal status law No. 347of 1959 the amended.

It was held in Nasiriyah city on Tuesday 21, November 2017, at the hall of the directorate of youth and sport with the presence of a number of the directorate female employees and some activists of civil society organizations in Dhi-Qar.

The seminar was initiated by our colleague Razzaq Obaid Dhaher by welcoming the attendants and giving an overview on Tammuz Organization, its activities and its participation in the campaign to cancel the proposal to amend the Personal Status Law 188.

The he provided a presentation on the proposal to amend the law and the loss of the acquired rights of women and society compared with the rights and guarantees enjoyed by women in the law in force, In addition to its conflict with many of the articles of the Constitution and the international conventions to which Iraq is committed.

He pointed out that the big protest by activists, lawyers, clerics, many parliamentarians and   civil organizations about the proposal is an ample proof of the danger of this law and the threat it represents on all of the Iraqi society.

  After an extensive discussion the definition and of the articles to be amended, it was agreed to confirm the position rejecting the proposed amendment based on the following observations:

 1- A decline of the democratic level in establishing a state on the basis of citizenship.

2-Based on Article 41, a controversial article covered by the articles to be amended.

3- Works to nurture and devote sectarianism and tearing apart the social fabric.

 4-marginalization and weakening of the judiciary and striking the principle of separation between the three powers provided for in the Constitution by giving the top executive power, which will be represented by the religious councils.

  5- Fragmentation of the unit of punishment when different doctrinal judgments given on similar situations and thus the violation of the Constitution, which provides for the equality of all Iraqis without discrimination before the law.

6- Encourage the marriage of little girls.

7- Transferring the crime of marriage outside the court to a sound legal situation, resulting in many legal, social and health problems.

8- Many of the gains of women and children are lost in regard to cases of marriage, inheritance, alimony, custody and others.

9- A decline in Iraq's international obligations regarding the charters on the rights of women and children, such as the Convention on the Rights of the Child and CEDAW and the Covenants on Civil, Political, Economic, Social and Cultural Rights.

 

 

  it is worth mentioning that the Tammuz Organization for Social Development allocates a large part of its work in the field of women's rights by implementing hundreds of projects and activities to raise awareness and rehabilitation and defend their rights in freedom, justice and equality. There is no social development without the active participation of women. Tammuz Social Development Organization is a member of the Iraqi Women's Network and the Coordinator of the Kahramana path to promote women's participation in decision-making positions.
