An awareness workshop on the legal rights of displaced people
Tammuz Organization for Social Development –Legal Clinic in Anbar Province held in cooperation with legal clinic network and UNHCR workshop in the 13th March.2016 in Sabe’ Sanabul in Amiriyah Fallujah, where 255 families from Anbar province. A number of Sabe’ Sanabul organization members attended this workshop such as Professor Hamoud Abdulla and professor Sami Kareem, and a number of representatives of civil society organizations and dignitaries of the region, including Mr. Hatem Saloa Issawi.
(52) IDPs (15 women and 37 men) from Al-Anbar participated in the seminar. Colleague Ali Ghazal opened the seminar and talked about the objectives of the workshop and its importance in the definition of IDPs rights and laws as well as advices and legal representatives, and he also clarified the role of Tammuz Organization for Social Development that carried out the project of clinic in Anbar and its goals and activates.
Then lawyer Mr.Sabti Juma Abbas presented a major intervention about the rights of IDPs in national legislations and definition of IDP according to Law No.21 of 2009 and terms of the registration, namely:
• The displacement place must be the same place of their residence before displacement.
• The causes of displacement set forth in Article II / first paragraph of the Migration and Displacement Act No. 12, as follows:
1. Avoid the effects of armed conflict
2. Avoid situations of general violence
3. Violation of human rights
4. A natural disaster or abuse of power or because of development projects
5. Get residence after displacement in a other place
6. The causes of displacement prohibitive of return only for statistical purposes.
There are detailed to definition all cases and proceedings concerning the rights of the IDPs, including new measures for the return in the case of the desire of the IDPs to return to the original place of residence, namely:
1) The displacement person, who want to return, must review Ministry of Migration and Displacement to register
2) IDPs can review the Ministry Branches in the place of their return after proving confirmation letters of local authorities.
3) Open file for any IDPs and put all their official documents in it
4) Take legal commitment of the return family confirming that they did not received any grant of other branches.
It has been put forward during the workshop a lot of interventions and inquiries from IDPs and most was about a million grant, where some of them did not receive the grant so far, and there were also inquiries about problems of 500 IDPs families from Jorf al-Sakhar on the ration card matter and also inquiries of IDPs families from Diyala, and in order to find answers and solutions for IDPs of Babil and Diyala provinces, it was contacted with colleagues in the legal clinics in Babil, Diyala and coordination with them to provide needed legal aids.
Finally the clinic director Mr. Ali Ghazal gave a presentation on the role of legal clinics network and services offered by the clinic in Anbar and the issues and how to communicate with the displaced families to provide free legal services in Anbar province, and also explained that the mobile Legal Clinic in all areas where displaced people, and have communication through the camps and complexes officials and coordination with them in order to provide services, in addition to hotlines to receive questions and inquiries throughout the week (07809447442 -07722429560).
At the end of workshop the attendees thanked members of organization and staff of legal clinic in Anbar for their efforts in carrying out this workshop because they could put forward their cases and advices; during the workshop organization has been received a number of cases and legal advices by IDPs.
