The eighth awareness workshop to ensure the legal rights of displaced people

Tammuz Organization for Social Development – Legal Clinic in Anbar Province has held in cooperation with LCN and UNHCR a legal workshop to ensure the IDPs rights on June 2, 2016 in Nasir Camp in Amryat Fallujah where living 270 displaced families, 30 persons of displaced attended the workshop (16 women & 14 men) with lawyer of LC Mohammed Abd Fayad.
Director of Legal Clinic in Anabr Ali Ghazal opened the workshop and welcomed attendees and then talked free legal services of LCN through the organizations in eight provinces where the displaced people live after their displacement from (Anbar, Nineveh, Diyala, Salah Din), and there is mutual work among organizations to promote workpaper of IDPs families within referring, affirmed that these organizations work in cooperation with LCN AND UNHCR and Tammuz Organization for Social Development presents legal services for IDPs from Anbar.
Lawyer of Legal Clinic Mohammed Abd Fayad presented a legal lecture and defined the IDPs rights in the national legislations and what was endorse the law of the Ministry of Migration and Displacement No.21 for 2009 on ensuring of displaced rights and define who is the displaced person, then pointed out the mechanisms of IDPs register in the offices of the ministry in the provinces, which they migrated to it and conditions of register and demanded documents to ensure their rights. Lawyer confirmed that each displaced person has right by the central government within the laws and legislations approved by the Ministry of Migration and Displacement.
During the workshop started the discussions by attendees, displaced person (Yasir Mohammed Roudhan) from Salah Din/ Dijeel District said that there are more than fifty displaced families from Dijeel and live in Nasir camp since more than a year and a half, knowing that their areas are liberated and does not know why they did not return to their areas, also have a replacement workpaper of Civil Status and issue of Nationality Cert to them and their children, in addition to add their children within the ration card, lawyer replied that the matter of return is not our work but it can arrange a demand by displaced person and submit to the concerned authorities, for ration card and department of civil status it can receive it and referring to the Justice Center to support of the marginalized groups in Iraq/ Salah Din province and this center is within the LCN.
Citizen Yusra Jlij Hamad said that her husband has died since more than one year and a half by Da’esh gangs in Hit district but has not issued death certificate for him yet, lawyer of legal clinic replied that it can issue a death documents from court after afford lawyer to issue a death document according to the legal procedures.
Colleague Ali Ghazal called Director of the Justice Center in Salah Din Mr.Saher Abdullah and informed him about these conditions, so Mr.Saher expressed his readiness to receive any workpaper within referring system.
Then lawyer Mohammed Abd Fayad presented an explanation on the voluntary return procedures for families who want to return according to the instructions of the ministry of Migration and Displacement, the mechanism of returning are as following:
1)Check the branch of the ministry in province
2)Bring all official documents (Childbirth certificate, Identification Card, Security Card and Residence card)
3)Open folder for displaced person
4) Legal commitment from returned family that they did not received the grant from any branch of the ministry.
5) Displaced person, who did not register, can registry their displacement during registry of returning with present a displacement and return documents in the same time.
Lawyer showed the readiness of legal clinic to receive all documents and cases that need to the legal representations by the legal clinic lawyer in Anbar and IDPs from another province (Diyala, Salah Din and Nineveh).
Colleague Ali Ghazal pointed out that there are hotlines of the legal clinic in eight provinces as mentioning in the brochure, and this is hotline of Tammuz Organization/Legal Clinic (07809447442 / 07722429560); it was distributed 100 brochures for IDPs during the seminar.
During the interventions, the attendees thanked the staff of legal clinic to follow-up the cases of IDPs, especially the regions of Anbar will liberate of Da’esh.
It is noteworthy that this is a eighth workshop of ten workshops held by Tammuz Organization, and will go on in hold the rest in other camps for IDPs till the end of the current year; and it is one of the activities of the Legal Assistance Project to help marginalized groups and IDPs of Anbar.
